Casing Amadou Diallo
Anthony Gair represents the mother of Amadou Diallo, who was shot 41 times by officers from the Street Crimes Unit at New York Police Street. New York City agreed to pay $ 3 million to Amadou Diallo's family. This amount is the largest amount ever paid by New York City in a misdemeanor over the death of a dependent individual.
Initial problem with remuneration count
The financial calculations for Diallo's death remuneration will be complicated: He has no wife or children; he was killed instantly (and therefore not qualified for pain and suffering compensation); Finally, he is a street vendor who earns $ 10,000 per year. But the city wants to throw out a prominent case, which has inspired a protest led by Al Sharpton. The NYPD and the city were heavily criticized for handling their investigations and insensitivity. Along with Abner Louima's rape, Amadou Diallo's case came to symbolize the police department that needed reform.
The first legal team led by Barry Scheck
Estate Diallo first hired Barry Scheck, Johnnie Cochran and Peter Neufeld to represent their interests; However, in 1999 both parents Mr. Diallo ordered that they be replaced. Instead, Kadiadou Diallo hired Gair.
An issue arose between a new legal team, led by Gair, and the Scheck team, which confirmed the $ 40,000 legal fee. Gair agreed to reimburse the fee; however, to move forward with the settings, the Sheck file must be transferred to Gair. Tim Gair turns to ask the court to order them to move, to which the Scheck team feels a heavy tactic. The real battle revolves around not the amount of Scheck team fees, but how they will be compensated. How the calculation will be the main determinant of the amount. $ 40,000 is just the starting point that both parties agree on. However, a Scheck spokesperson feels that they should be paid a percentage of assessment or settlement. But Gair's team felt compensation should be paid on quantum whistle, which means the percentage calculated by determining the percentage of work each company put in to win the final amount.
Company Gair takes over case
Judge Lee Holzman argued that Gair's advice would lead, which would place him in a more favorable position than any other company. His company receives 62.5 percent of attorneys' fees (usually equal to one-third of the settlements, which remain uncertain).
Resolution for all parties
The case ultimately led to a federal investigation and the dissolution of the NYPD Street Crime Unit. On January 6, 2004, the Diallo family approved a $ 3 million settlement. Neither the NYPD nor the city acknowledged any wrongdoing, but they declared with "regret what happened and extended [our] sympathy to the Diallo family." Mrs. Diallo initially sought $ 20 million in damages and $ 41 million in damages. All parties reportedly agreed that the settlement was fair, including the officers, the city, the NYPD, and the Diallo plantation. "What we lost can not be replaced, but we agreed to join hands with the city and accept this closure," said Kadiadou Diallo. Mayor Michael Bloomberg said: "It's not a substitute for human life, but it's a chapter of our history and I'm glad we can come to a financial settlement with family and let's get on with it."
Legal scion
Gair comes from a different legal tradition. His father Harry A. Gair founded Gair & amp; Gair in 1945 when Harriet Gair (d.2006) became a partner in the company. He has worked for Harry since he was fifteen years old. Harriet attended New York University Law School and received LL.B. in 1940. He became a managing partner in 1945. He is President of the New York Women's Bar Association, and remains a firm adviser who passes 90 years.
