The tort of seduction is a civil error or error in the common law legal system, and still exists in some jurisdictions.

An unmarried woman may sue for reasons of seduction to get damages from the teaser, if her consent to sex is based on a mistake.

Legal basis

Initially, tort seduction is a drug for the benefit of the father's property in the sanctity of his daughter. However, the damage his father would give was based on the loss of the father from the services of a daughter, just as an employer could sue if a third party caused injury to his servant who made the servant unable to work, because he was "seduced and immoral" and became pregnant as a result of non-marital sexual activity. The seduction of seduction was one of the most common civil actions towards the end of the nineteenth century, and fathers often succeeded before jurors.

In the 20th century, the action was criticized for maintaining "ownership interest in humans", and the lawsuit was rearranged to recognize personal injury to the woman, not merely the deprivation of a father's property. Most jurisdictions give victims (disadvantaged women) the right to sue on their own behalf. (Father can still sue, on the grounds that they have a moral interest in the sanctity of their daughters). The woman who demands it "is usually but not always a virgin".

English

Historically, women who are tempted can not bring their own suits. Instead, it will be brought by his father, acting under the legal fiction that the parent-child relationship is under a master-servant relationship. However, if the girl is a contract slave, the clothes can not be brought by his father to his master.

Canada

Property rights and civil rights are provincial forces in Canada, so that all claims may vary by province.

Ontario

The law to make the drug for seduction cases more effective, and for the tender father of illegitimate children who were responsible for their support, was ratified in Upper Canada on 4 March 1837. Changing traditional customary law, it allowed the father to prosecute girls they're a master for tort seduction. It also makes the biological father responsible for the children conceived out of wedlock.

The Seduction Act was lifted in 1978.

Alberta

The 1934 John Brownlee sex scandal revolves around a seduction outfit.

Other provinces

An 1852 law on Prince Edward Island allows a woman to be tempted to sue herself on this charge, even though the damage is limited to 100 pounds. Manitoba and the North West Territories impose similar rules around the turn of the 19th century.

United States

In the United States, tort seduction has been removed in "most countries". False attire concerns, combined with turning away from the view of property interest in people, leading to the enactment of "balm heart" laws, eliminating causes of action for seduction, breach of promise, alienation of affection, criminal conversation, etc. in most countries in the 20th century.
